Terms and Conditions

These Terms & Conditions govern all services provided by CAV Services (“we,” “us,” “our”). By booking or using our services, the client (“you,” “your”) agrees to the following: 

  1. Booking & Scheduling 
    • All bookings must be confirmed in writing (email, message, or signed agreement). 
    • Project dates and times are subject to availability and will only be secured upon confirmation. 
    • Clients must provide a clear project scope including: 
    • Location(s) 
    • Purpose of the work 
    • Specific deliverables or requirements 
    • Any changes to scope after confirmation may result in adjusted pricing and timelines. 
  2. Weather & Flight Conditions 
    • All drone operations are dependent on safe weather and compliant flight conditions. 
    • CAV Services reserves the right to delay, reschedule, or cancel operations due to: 
    • High winds, Rain, snow, fog, or reduced visibility 
    • Airspace restrictions or NOTAMs 
    • Equipment or safety concerns 
    • Weather-related rescheduling will not incur additional fees. 
    • We are not responsible for delays caused by conditions beyond our control. 
  3. Cancellations & Rescheduling 
    • Cancellations made 24 hours or more before the scheduled service will not incur a fee. 
    • Cancellations made within 24 hours may be subject to a partial charge. 
    • No-shows or same-day cancellations may be charged up to the full booking amount. 
    • Rescheduling requests are accommodated where possible but are subject to availability. 
  4. Flight Permissions & Regulatory Compliance 
    • All drone operations are conducted in compliance with Transport Canada regulations and applicable laws. 
    • CAV Services reserves the right to refuse or terminate services if: 
      • The requested operation is unlawful or unsafe 
      • Adequate permissions cannot be obtained 
      • Environmental or situational risks are identified 
    • Where required, clients are responsible for assisting with: 
      • Property access permissions 
      • Site-specific approvals 
    • Final flight decisions are at the sole discretion of the licensed drone pilot. 
  5. Site Access & Readiness 
    • Clients must ensure safe, timely, and lawful access to all required filming locations. 
    • The site must be prepared and ready at the scheduled time. 
    • For real estate: properties should be clean, staged, and accessible. 
    • Delays caused by lack of access or readiness may result in: 
      • Additional charges 
      • Reduced service time 
      • Rescheduling fees 
  6. Fees & Payment Terms 
    • Pricing will be outlined in advance via quote or agreement. 
    • Unless otherwise agreed: 
      • Payment is due upon project completion, unless otherwise agreed on per terms of SOW/MSA Agreement. 
    • Accepted payment methods may include: 
      • Cash 
      • Credit/debit cards 
      • Electronic transfer (if offered)
      • Cheque – Payments by cheque are accepted at our discretion. Cheques marked ‘full and final settlement’ for less than the total outstanding balance will be accepted as partial payment only, and we reserve the right to pursue the remaining balance.
        A fee of $60.00 will be charged for any returned cheques. 
    • Late Payment: Unless otherwise contractually agreed; Late payments are subject to a fee of $25 and accrue interest at 2% per month (or the maximum lawful rate, whichever is lower), plus reasonable collection costs.
  7. Deliverables & Turnaround 
    • Typical delivery timelines: 
      • Photos: within 24 hours 
      • Video projects: 48–72 hours 
      • Mapping/survey work: 2–4 business days 
        (Timelines may vary based on project scope
    • Unless otherwise agreed upon in writing:
      • Final deliverables are digital media.
      • Provided via download link or secure gallery. 
    • Rush delivery may be available for an additional fee. 
  8. Revisions & Additional Work 
    • Minor edits (e.g., color correction, brightness, cropping) are included where appropriate. 
    • Additional revisions, including: 
      • Major video changes 
      • Re-edits beyond original scope 
      • Re-shoots due to client changes 
        may incur additional charges. 
  9. Intellectual Property & Usage Rights 
    • Unless otherwise agreed in writing: 
      • CAV Services retains full copyright ownership of all produced media. 
    • Clients are granted a non-exclusive, royalty-free license for: 
      • Personal use 
      • Marketing and commercial use 
    • Clients may not: 
      • Sell, license, or redistribute media to third parties without written consent 
    • CAV Services reserves the right to use project media for: 
      • Portfolio 
      • Marketing and promotional purposes
      • The client may opt out in writing prior to the commencement of the project. 
  10. Insurance & Liability 
    • CAV Services maintains appropriate insurance coverage for drone operations. 
    • We are not liable for: 
      • Delays due to weather, airspace restrictions, or regulatory requirements 
      • Incomplete deliverables caused by site conditions or client constraints 
    • Clients are responsible for ensuring: 
      • Safe conditions on-site 
      • That all necessary permissions and access rights are obtained 
    • Liability is limited to the total value of the service provided. 
  11. Privacy & Data Protection 
    • We respect privacy and will not intentionally capture identifiable individuals without consent, unless permitted in public spaces. 
    • Clients are responsible for obtaining consent when filming on private property or in sensitive environments. 
    • Collected data and imagery will be handled securely and used only for intended project purposes.
    • If requested and feasible, CAV Services can apply anonymization (e.g., blurring of faces, logos or license plates) as an additional service for a fee.
  12. Force Majeure
    CAV Services is not responsible for failure to perform due to unforeseen circumstances beyond our control, including but not limited to: 
    • Natural disasters 
    • Government restrictions 
    • Airspace shutdowns 
    • Equipment failure outside reasonable control 
  13. Indemnification
    The client agrees to indemnify, defend, and hold harmless CAV Services, its owners, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:
    • The client’s use or misuse of the delivered media
    • Any breach of these Terms & Conditions by the client
    • Failure to obtain necessary permissions, consents, or approvals for filming locations or subjects
    • Any third-party claims related to property rights, privacy violations, or unauthorized use of media
    • CAV Services shall not be held liable for any claims arising from the client’s distribution, modification, or use of the deliverables beyond the scope of the agreed license.
    • The client assumes full responsibility for ensuring that all requested work complies with applicable laws and regulations.
  14. Service Level Agreement (SLA)
    CAV Services is committed to delivering reliable, high-quality drone service operations.
    The following service levels apply unless otherwise specified in writing:
    • Service Availability
      Services are scheduled based on confirmed bookings and are subject to:
      • Weather conditions
      • Airspace restrictions
      • Regulatory approvals
      • CAV Services will make reasonable efforts to meet all scheduled dates and timelines but does not guarantee availability due to external constraints.
    • Response Times
      • General inquiries: response within 1 business day
      • Quote requests: within 1–2 business days
      • Project updates or client communications: within 1 business day
    • Delivery Timelines
      • Standard delivery timelines (as outlined in Section 7) apply.
      • Delivery timelines begin once:
        • The project is completed, and
        • All required information and access have been provided
      • Delays caused by client requests, revisions, or incomplete project details may extend timelines.
    • Quality Assurance
      • All deliverables will:
        • Meet professional industry standards for drone imaging
        • Be reviewed for technical quality (focus, exposure, basic editing)
      • CAV Services does not guarantee specific visual results where factors such as lighting, environment, or location constraints are beyond control.
    • Issue Resolution
      • Clients must report any concerns or deficiencies within 3 business days of delivery.
      • CAV Services will:
        • Review and assess reported issues
        • Provide reasonable corrections or clarification where applicable
      • Remedies are limited to:
        • Revisions (where feasible), or
        • Partial re-service at the discretion of CAV Services
    • Service Limitations
      SLA commitments do not apply where performance is impacted by:
      • Weather or environmental conditions
      • Regulatory or legal restrictions
      • Third-party delays (e.g., property access issues)
      • Client-caused delays or changes in project scope
  15. Acceptance of Terms 
    By engaging CAV Services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
